Terms of Service

These terms govern your use of thefluencyformula.com (the "Site") and your enrollment in Fluency Formula programs. "We," "us," and "our" refer to Fluency Formula Inc., an Ontario, Canada corporation. By using the Site, or by checking the terms box at checkout and enrolling in any program, you agree to these terms. If you do not agree, please do not use the Site or enroll.

Scope of services

Fluency Formula provides language learning education through this Site, the Fluency Formula App (app.thefluencyformula.com), a community platform hosted on Skool, live group calls, and associated digital content. The FF App is in active development; features may change and occasional bugs are part of shipping fast, and we fix them quickly.

Accounts

If you create an account on any platform connected to Fluency Formula (the FF App or our Skool community), you are responsible for keeping your login credentials secure and for all activity under your account. Each membership is for one person. Accounts and program access may not be shared, including with family members. If two people in your household want to use the program, each needs their own membership.

Anyone under 18 needs a parent or guardian's permission to enroll, and the parent or guardian accepts these terms on their behalf.

Newsletter

When you submit your email through a form on this Site, you are asking to receive emails from Fluency Formula. You can unsubscribe at any time using the link in every email.

Payment

Fluency Formula Pro is a paid program. By enrolling you agree to the price and payment plan stated at the time of purchase. All amounts are in USD unless stated otherwise. We use Stripe to process payments; Stripe's terms apply to the transaction itself.

Installment plans. If you choose a split-payment plan, you authorize us to automatically charge the remaining installment to the same payment method 30 days after your first payment. You do not need to take any action for that charge to occur. If an installment payment fails, we will contact you to update your payment method; while it remains unpaid, your program access is suspended, and if it is not resolved after we reach out, your membership may be ended without refund of prior payments.

Gift purchases. You may purchase the program as a gift by entering the recipient's email at checkout. The recipient's use of the program is governed by these terms.

Program access

Fluency Formula Pro includes lifetime access, meaning access for as long as the program operates, to the course content, the FF App, the community, and future releases made available to members. Access begins immediately upon successful payment.

The curriculum is built in a deliberate sequence. Later modules unlock as designed. You may request early unlock or make other changes to your protocol, but doing so may affect your guarantee (see the refund policy below).

Refund policy and 90-day guarantee

Fluency Formula Pro comes with a 90-day "do the work" guarantee. It is designed to remove the risk of the outcome: if you genuinely do the work and the program is not right for you, you get your money back.

The window. The guarantee window opens on Day 8 of your enrollment and runs through Day 97. There is no trial period; you receive full access to the entire program from day one, and the guarantee is the safety net.

The criteria. The guarantee is built around the daily commitment you set at onboarding. To qualify for a refund you must have logged at least 90% of your target input hours in the FF App (your original daily commitment multiplied by 90 days) and kept a flashcard pace consistent with your committed tier. The app tracks this automatically, so both of us can see whether the work was done.

Changes that may void the guarantee. The guarantee is built around a specific protocol. Deviating from that protocol may void it, including: unlocking later courses or modules early, switching your target language mid-program, changing your daily commitment up or down from the original baseline, or pausing your flashcards. You are always free to make these changes; they simply may trade away some or all of the guarantee.

The offboarding call. Before any refund is processed, we hop on a quick offboarding call together. Two reasons: one, we verify identity so the refund goes to the right cardholder, and two, it gives us a chance to see what didn't work for you. The call is for your protection, not a sales save. The offboarding call is the single path for all refund and cancellation requests.

Amounts. If the criteria are met, pay-in-full members receive a full refund. Split-pay members receive a refund of all collected installments, or a refund of the first installment and cancellation of the second, depending on billing status at the time of the call.

To request a refund, message an admin inside the Skool community. Skool is where all member communication happens, including this.

Community standards

The Fluency Formula community is private and moderated. By joining you accept that:

• Self-promotion of any kind (your business, another community, another social page) is not allowed, in posts or in DMs.
• Honest feedback and constructive criticism are welcome. Posts that are negative for the sake of negativity, attacks on other members, or hostility without an attempt to engage constructively are not.
• We may warn, restrict, or remove members who violate these standards, at our judgment, depending on severity.

Recording and redistribution. Live calls (including cohort calls and coaching calls) may not be recorded, captured, or distributed by members for any reason. Course materials (videos, PDFs, slides, classroom assets) may not be shared outside the community. Violating this section results in immediate removal from the program without refund. This is the firmest line in the community.

Member privacy. The community is a private space. Do not share other members' posts, messages, or personal information outside of it.

You may share short clips of Fluency Formula content on your own channels if you clearly credit Fluency Formula.

Your content and marketing use

The community works because members share their journeys. By enrolling, you grant Fluency Formula a perpetual, royalty-free license to use content you share within the program (posts, comments, wins, messages to the team, and your appearance on live calls) in our marketing and materials. You keep ownership of your content; this is a license, not a transfer.

If you would like something specific kept private, tell us and we will honor it. Beyond program participation, we do not share your personal information with other organizations without your permission; see our privacy policy.

Intellectual property

All content on this Site and in the program, including writing, video, images, course material, the FF App, and brand identity, is owned by Fluency Formula Inc. unless otherwise noted. You may share links to public pages freely. You may not republish full articles, reproduce or resell course material, or copy the design of this Site or App without written permission.

Third-party links

The Site links to services we operate and to external platforms including YouTube, X, Instagram, and Skool. Those services have their own terms and policies, which we do not control.

No warranty and results disclaimer

The Site and its content are provided as-is. Language learning results depend on your effort, starting level, and consistency. Other than the 90-day guarantee described above, we do not promise any specific outcome or timeline. Testimonials and student results shown on this Site are real but are not a promise that you will achieve the same results.

Limitation of liability

To the maximum extent permitted by applicable law, Fluency Formula Inc. will not be liable for any indirect, incidental, or consequential damages arising from your use of this Site, the program, or our content, and our total liability for any claim will not exceed the amount you paid us for the program or content the claim relates to.

Billing questions and disputes

If you believe a charge is incorrect, message an admin inside the Skool community before disputing the charge with your bank or card issuer, and we will work with you to resolve it quickly.

Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable in it. Any disputes will be resolved in the courts of Ontario.

Changes

We may update these terms occasionally. The "Last updated" date at the top shows when. Material changes will be announced through the newsletter. Your enrollment is governed by the terms in effect at the time of your purchase.
